Terms of Service for Smart Pantry AI

1. Acceptance of Terms

By accessing or using Smart Pantry AI (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Smart Pantry AI is a mobile application that helps users:

• Track food inventory and expiration dates
• Scan product barcodes and labels
• Generate recipe suggestions using AI
• Manage multiple pantries
• Save and organize recipes

3. User Accounts

3.1 Account Creation

• You must provide a valid email address and create a password
• You must be at least 13 years of age to use this App
• You are responsible for maintaining the security of your account
• You are responsible for all activities under your account

3.2 Account Security

• Keep your password confidential
• Notify us immediately of any unauthorized access
• We are not liable for losses due to unauthorized account use

3.3 Account Termination

• You may delete your account at any time through the Settings screen
• We reserve the right to suspend or terminate accounts that violate these Terms
• Upon termination, your data will be permanently deleted within 30 days

4. User Content

4.1 Your Data

• You retain ownership of all data you input into the App (inventory items, photos, recipes)
• You grant us a limited license to process your data to provide the service
• You are responsible for the accuracy of information you provide

4.2 Acceptable Use

You agree NOT to:

• Upload illegal, harmful, or offensive content
• Attempt to hack, reverse engineer, or exploit the App
• Use the App for commercial purposes without permission
• Violate any applicable laws or regulations
• Spam or abuse the service with excessive requests
• Share your account credentials with others

4.3 Photos and Images

• You must have the right to upload any photos you submit
• Photos are processed for product information extraction
• We do not store photos long-term unless necessary for functionality

5. AI-Generated Content

5.1 Recipe Generation

• Recipes are generated by AI (OpenAI, Anthropic) and may not always be accurate
• We do not guarantee the safety, taste, or nutritional value of AI-generated recipes
• You are responsible for verifying recipe safety and suitability
• Follow proper food safety guidelines when cooking

5.2 Product Information

• Barcode and OCR data may be inaccurate
• Always verify expiration dates and product information
• We are not liable for food safety issues or spoiled products

6. Intellectual Property

6.1 Our IP

• The App, including its design, code, and features, is owned by Smart Pantry AI
• Our trademarks, logos, and branding are protected
• You may not copy, modify, or redistribute the App without permission

6.2 Third-Party Content

• Product data from Open Food Facts is licensed under ODbL
• AI models are provided by OpenAI and Anthropic
• Icons and design elements may be from third-party libraries

7. Third-Party Services

We use the following third-party services:

• OpenAI / Anthropic: Recipe generation and product identification
• Open Food Facts / UPCitemdb: Barcode product lookup
• Sentry: Error tracking and monitoring
• Google Cloud Platform: Hosting and infrastructure
• Apple / RevenueCat: Subscription purchases and status

Your use of these services through our App is subject to their respective terms of service.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:

• Fitness for a particular purpose
• Accuracy or reliability of content
• Uninterrupted or error-free operation
• Security of data transmission

YOU USE THE APP AT YOUR OWN RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for any indirect, incidental, or consequential damages
• We are not liable for food poisoning, allergic reactions, or health issues
• We are not liable for data loss, though we take reasonable precautions
• Our total liability shall not exceed the amount you paid us in the 12 months before the claim

10. Food Safety Disclaimer

IMPORTANT:

• Always verify expiration dates on physical products
• Follow proper food storage and handling guidelines
• Check for allergies before consuming AI-suggested recipes
• When in doubt, throw it out
• We are not responsible for foodborne illnesses

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your misuse of the App
• Your violation of any laws or third-party rights
• Content you upload or actions you take in the App

12. Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to our collection and use of your data as described in the Privacy Policy.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Updating the "Last Updated" date
• Posting a notice in the App
• Sending an email to your registered address

Continued use after changes constitutes acceptance of the new Terms.

14. Subscriptions and Payments

14.1 Free and Premium Plans

• The App offers a free plan with a limited daily allowance of AI features (recipe generation and label scanning)
• Smart Pantry AI Premium is an optional auto-renewing subscription with a higher daily AI allowance
• Daily allowances reset at midnight UTC and may be adjusted to prevent abuse

14.2 Billing and Renewal

• Premium costs $4.99 per month in the US, or the local price shown in the App Store before purchase
• Payment is charged to your Apple ID account when you confirm the purchase
• Your subscription renews automatically unless canceled at least 24 hours before the end of the current period
• Your account is charged for renewal within 24 hours before the end of the current period
• Manage or cancel anytime in your device Settings: tap your name, then Subscriptions
• If you cancel, you keep Premium until the end of the period you paid for

14.3 Refunds

All payments are processed by Apple. Refund requests are handled by Apple under its policies at https://reportaproblem.apple.com.

14.4 Price Changes

We may change subscription prices. Apple will notify you in advance as required, and you can cancel before a new price applies.

15. Geographic Restrictions

The App is primarily intended for users in the United States. If you access from other locations, you are responsible for compliance with local laws.

16. DMCA and Copyright

If you believe your copyright has been infringed, contact us at support@smartpantryai.app with:

• Description of the copyrighted work
• Location of infringing material
• Your contact information
• A statement of good faith belief
• A statement under penalty of perjury

17. Dispute Resolution

17.1 Governing Law

These Terms are governed by the laws of California, United States, without regard to conflict of law principles.

17.2 Arbitration

Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

17.3 Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class actions.

17.4 Exceptions

Either party may seek injunctive relief in court for intellectual property infringement.

18. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

19. Entire Agreement

These Terms, along with the Privacy Policy, constitute the entire agreement between you and Smart Pantry AI.
